Prenuptial Agreements (“Prenups”)

While planning for separation, divorce, or death is not the most romantic topic, it is important to consider how certain matters should be handled to protect your needs and minimize the strain of divorce, death, or an unhappy, life-changing event. Prenups are voluntary contractual agreements that must be in writing, negotiated, and signed. Each couple should also have their own legal representation. Investing in a well-drafted prenuptial agreement allows couples to avoid unnecessary and expensive litigation down the road.

Postnuptial Agreements (“Postnups”)

Postnups are contractual agreements made between partners after marriage. Postnups can also modify or terminate Prenups by mutual consent. Hence, couples who did not have an opportunity to address how assets, spousal support, or alimony will be handled before entering into marriage can do so with a Postnuptial Agreement. Note, Postnuptial Agreements cannot eliminate child support payments or establish the amount that will be paid, nor can they establish child custody or visitation rights, which must adhere to the state laws where the couple resides.
